Terms of Service

1. Acceptance of Terms

By accessing or using InstaPV (the "Service"), available at https://www.instapv.ai (the "Site"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and InstaPV ("we", "us", "our").

2. Description of the Service

InstaPV is a web-based platform that lets you view and download publicly available Instagram content — profiles, posts, reels, highlights, profile pictures, and recent-followed activity — anonymously, without logging in to Instagram. We do not bypass privacy settings, do not access private accounts, and do not require Instagram credentials from you.

Premium subscription tiers extend the Service with full story playback, deeper browsing, and original-quality downloads.

3. Eligibility

You must be at least 16 years old to use the Service. If you are under 18, you must have permission from a parent or guardian. By using the Service you represent that you meet these requirements.

4. Account Registration

4.1 Free Access

Basic viewer features are available without creating an account, subject to the daily usage limits shown in the interface.

4.2 Premium Account

To unlock Profile Pro or Premium Viewer, you must sign in (typically via Google through Firebase Authentication) and provide payment information for processing by our payment partner Creem.

You are responsible for:

• Keeping your account credentials confidential.
• All activity that occurs under your account.
• Notifying us promptly of any unauthorized access or suspected breach.

5. Acceptable Use

You agree not to use the Service to:

• Harass, stalk, threaten, or harm any individual.
• Violate Instagram's Terms of Service, Community Guidelines, or any applicable law or regulation.
• Infringe on intellectual property or privacy rights of others.
• Engage in automated access, scraping, or crawling beyond ordinary personal use, or to circumvent rate limits.
• Attempt to gain unauthorized access to our systems, accounts, or back-end services.
• Distribute malware, viruses, or other harmful code through the Service.
• Interfere with or disrupt the Service, our servers, or other users' access.
• Impersonate any person or entity, or misrepresent your affiliation with anyone.
• Resell, sublicense, or share Premium account credentials.
• Collect or harvest information about other users.
• Use the Service in any way that could damage the reputation, integrity, or operation of InstaPV.

Downloaded content remains the intellectual property of its original creator. You may not redistribute, resell, or commercially exploit it without the creator's permission.

We reserve the right to investigate and take appropriate action — including suspension or termination of accounts and access — against any user who violates this section.

6. Subscription Terms

6.1 Plans and Pricing

InstaPV offers Free, Profile Pro, and Premium Viewer plans. Current pricing and billing cycles are displayed on the pricing page and at checkout. We may change pricing with at least 30 days' notice to active subscribers; price changes do not affect a billing cycle already in progress.

6.2 Payment

Payment is processed by our third-party processor Creem. By subscribing, you authorize us and Creem to charge your payment method for the applicable fees, including any taxes.

6.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period at the then-current rate unless canceled before renewal.

6.4 Cancellation

You may cancel a subscription at any time from your account menu, or by contacting deloris@deloris-ai.com. Cancellation takes effect at the end of the current billing period; you retain Premium access through that date.

6.5 Refunds

Cancellation does not entitle you to a refund of fees already paid, except where required by applicable law. We may issue refunds at our discretion in cases of billing errors, prolonged service outages affecting Premium features, or other exceptional circumstances.

6.6 Failed Payments

If a payment fails, we may retry it and notify you. Continued failure may result in suspension or cancellation of your Premium subscription.

7. Service Availability and Modifications

The Service is provided on an "as is" and "as available" basis. We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free.
• Instagram public data will always be available, current, or accurate.
• Any specific feature will remain available indefinitely.

Because the Service depends on access to publicly available Instagram data, changes to Instagram's platform, policies, or technical architecture may force us to modify, suspend, or discontinue features without liability to users. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.

8. Intellectual Property

8.1 Our Rights

InstaPV — including the Site, the Service, our software, designs, graphics, text, and branding (excluding third-party Instagram content) — is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, reverse-engineer the software, or use our trademarks or branding without permission.

8.2 Instagram Content

All Instagram content surfaced through the Service — posts, stories, reels, highlights, profile pictures — is the property of the respective Instagram users and Meta Platforms Inc. We do not claim ownership of any Instagram content. By using the Service, you agree to respect content creators' intellectual property rights.

8.3 User Submissions

Any feedback or suggestions you provide may be used by us without obligation to you.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy or reliability of information, and uninterrupted or error-free operation.

We do not warrant that the Service will meet your expectations, that Instagram data will be accurate or complete, that defects will be corrected, or that the Service is free from viruses or harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, InstaPV and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or use, service interruptions, unauthorized access to your data, or errors in content.

Our aggregate liability for any direct damages arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) USD $100. Some jurisdictions do not allow these limitations, so they may not fully apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless InstaPV, its officers, employees, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any content you view, download, or share through the Service.

12. Third-Party Services and Links

The Service may contain links to or integrations with third-party services. We are not responsible for the availability, accuracy, content, privacy practices, or terms of those third parties.

13. Disclaimer Regarding Instagram

InstaPV is NOT affiliated with, endorsed by, authorized by, or officially connected to Instagram, Meta Platforms Inc., or any of its subsidiaries or affiliates. The official Instagram website is instagram.com.

We access only publicly available Instagram data and:

• Do not store your Instagram credentials.
• Do not directly integrate with Instagram's private API.
• Do not bypass any Instagram privacy or security control.

Instagram may change its policies or take action that affects services like ours. You are responsible for ensuring that your use of the Service complies with Instagram's Terms of Service. We are not liable for any consequences resulting from Instagram's actions or policy changes.

14. Termination

You may stop using the Service or cancel your subscription at any time. We may suspend or terminate your access to the Service immediately, with or without notice, for violation of these Terms or our Acceptable Use Policy, fraudulent or abusive activity, non-payment of fees, or any other reason at our sole discretion. Upon termination, your right to use the Service ends immediately, and we may delete your account data subject to applicable legal retention obligations. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will remain in effect.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes arising from these Terms or the Service shall be resolved as follows:

• Informal resolution — first contact deloris@deloris-ai.com to attempt to resolve the matter informally.
• Binding arbitration — if informal resolution fails, disputes will be resolved by binding arbitration administered under the rules of the American Arbitration Association, in Delaware or remotely, rather than in court.
• Exception — either party may seek injunctive relief in court for intellectual-property infringement or unauthorized access to systems.

Class-action waiver: you agree to bring claims only in your individual capacity and not as part of a class or representative action; class arbitrations and consolidated proceedings are not permitted.

16. General Provisions

• Entire agreement — these Terms, together with our Privacy Policy, constitute the entire agreement between you and InstaPV regarding the Service.
• Severability — if any provision is found unenforceable, the remaining provisions remain in effect.
• No waiver — our failure to enforce a provision is not a waiver of that or any other provision.
• Assignment — you may not assign these Terms without our written consent; we may assign them without restriction.
• Force majeure — we are not liable for failure or delay caused by circumstances beyond our reasonable control.
• Changes — we may modify these Terms at any time. Material changes will be communicated by updating the Effective Date and, where appropriate, by notice on the Site or by email. Continued use of the Service after changes take effect constitutes acceptance.

17. Export Controls

You agree to comply with all applicable export and re-export control laws and regulations.
